Terms of Service

These Terms of Service ("Terms") govern your access to and use of the services, websites, and applications (collectively, the "Service") provided by Client Compass ("we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms.

1. Who we are

Client Compass is a sole proprietorship operating in South Africa, providing tools to help stylists capture WhatsApp leads into Google Sheets and receive email notifications.

2. Eligibility

You must be at least 18 years old and able to form a binding contract under South African law to use the Service.

3. Your account

You are responsible for maintaining the confidentiality of any credentials associated with the Service and for all activities under your account. Notify us promptly of any unauthorised use.

5. Fees and billing

Pricing and payment terms (if applicable) are communicated separately. Where fees apply, you agree to pay all charges and applicable taxes. Late or failed payments may result in suspension of the Service.

6. Privacy

Your use of the Service is subject to our Privacy Policy, which explains how we collect and process personal information and identifies Client Compass as the Responsible Party under POPIA.

7. Data processing; third-party services

We may use third-party service providers (e.g., email delivery, logging, hosting). Where we act as an operator (processor) for your end-customer data, we will process such data only to provide and improve the Service and as described in the Privacy Policy.

8. Availability and changes

We strive for high availability but do not guarantee uninterrupted Service. We may modify, suspend, or discontinue features at any time with reasonable notice where practicable.

9. Intellectual property

The Service, including its software and content (excluding your content), is owned by or licensed to Client Compass and is protected by law. You receive a limited, non-exclusive, non-transferable licence to use the Service.

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. To the maximum extent permitted by law, we disclaim all warranties, including fitness for a particular purpose, merchantability, and non-infringement.

12. Limitation of liability

To the maximum extent permitted by law, Client Compass will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenues, arising from or related to your use of the Service. Our aggregate liability shall not exceed the amount paid by you to us for the Service in the 3 months preceding the claim (or R0 if no fees were paid).

13. Indemnity

You agree to indemnify and hold Client Compass harmless from any claims, liabilities, damages, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Service or violation of these Terms.

14. Governing law and jurisdiction

These Terms are governed by the laws of the Republic of South Africa. You consent to the exclusive jurisdiction of the courts of South Africa for disputes arising out of or related to these Terms.

15. Termination

We may suspend or terminate your access if you materially breach these Terms. Upon termination, your right to use the Service ceases immediately.

16. Changes to these Terms

We may update these Terms from time to time. We will post the updated Terms on this page with the updated date. Your continued use of the Service after changes become effective constitutes acceptance.
